GENERAL CONDITIONS
1.1 These terms of use (Terms of use) govern the general rules for using the website www.urbanscans.com (the Website). With each access to the Website and/or use of the Website's resources, users declare that they are familiar with the present conditions, agree with them and undertake to comply with them.
1.2 The Terms of use may be changed at any time by the owner of the Website, without prior notification to the users. The respective change takes effect from the publication of the amended Terms of use on the the amended Terms of use on www.urbanscans.com. Users should check the Website themselves for changes in the Terms of use page, and the owner of the Website is not obliged to inform them in any other way, except through the newest publication of the amended Terms of use on the Website.
2. WEBSITE DESCRIPTION
2.1 The page has a representative, informational, educational and scientific purpose - to store, present, promote and distribute information and digital data about works of fine art and architecture (monuments, sculptures, monuments, buildings) of Bulgaria.
2.2 The website is a non-profit project and does not aim to derive profit or other commercial or economic benefit in any form and by any means.
2.3 The resources that the Website offers free of charge to the Users are:
• digital three-dimensional models of works of fine art and architecture;
• point cloud used to reproduce the three-dimensional models;
• photographic images, based on which a data cloud and a three-dimensional model were built;
• other useful information about works of art and architecture.
2.4 Access to the Website's data is free and without any charge
3. USE OF RESOURCES. INTELLECTUAL PROPERTY RIGHTS
3.1 All intellectual property rights on the resources published on the Website (including, but not limited to, the resources specified in item 2.3 of the Terms of use - three-dimensional models, point clouds and data, photographic images, as well as the video materials published on the page, text , interviews), collectively referred to as the "Resources", belong to the owner of the Website and are subject to protection under the current Copyright and Related Rights Act. Their unregulated use constitutes a violation of the law and entails civil, administrative and criminal liability in accordance with the current Bulgarian legislation.
3.2 The use of Resources from the Website is permitted only when their source is correctly indicated as follows: "Resources are taken/copied from www.urbanscans.com".
3.3 Users have the right to use the Resources from the Website only in the following ways: to browse them; to copy and save them on a computer, mobile device or electronic data carrier; include them as part of other non-commercial works and materials (eg articles, research papers, presentations, reports); to distribute them on social media and the Internet. Use in the ways described above in this point is permitted only for personal needs, for educational, scientific or informational purposes and only after correctly indicating the source of the Resources, in the manner stipulated in point 3.2 above. Any other way of use or for other purposes is possible only after the prior written permission of the owner of the Website. Users are required to indicate if changes were made to the Resources. If that may be the case, they should be done in a reasonable and respectful manner, but not in any way that suggests the licensor endorses you or your use.
3.4 Three-dimensional digital models can also be used in the context of conservation of works of art and architecture and to assist in their restoration in the event of destruction or damage.
3.5 Users may not copy, reproduce, publish, publicize, distribute and use the Website Resources in any way and in any form and in any medium or media for commercial purposes or derive from them directly or indirect economic benefit. Unless written permission is given of the copyright owner of both digitally scanned model and original culture object.
3.6 When using the Resources, users undertake to do so in a way that does not violate the law and intellectual property rights on the Resources. In addition, users should respect their cultural and historical value and use them in a respectful manner.
3.7 Users have no right to use the Resources for political and party purposes, for religious purposes, for preaching ideologies (including but not limited to national socialism, communism, anti-Semitism, totalitarianism, dictatorship, racism, as well as their opposite ideologies), instilling division on ethnic, racial or other grounds, incitement to violence, crime, hatred or terrorism.
4. LIMITATION OF LIABILITY
4.1 Each user of the Website bears personal responsibility for the way he uses the Website and the Resources placed on it.
4.2 The owner of the Website is not responsible for the actions or inactions of users who have violated these Terms of use, or the copyrights on the scanned objects or on the works of fine art and architecture themselves. The owner of the Website warns users that all or part of the works of fine art and architecture, the digital models of which are present on the Website, may represent movable or immovable cultural assets and are under the protection of the Law on Cultural Heritage, as well as their use (including the use of their photos and images) to be subject to special rules regulated in the legislation of the Republic of Bulgaria.
5. OTHER
5.1 Visiting the Website and using the Resources it contains is not bound by the need for user registration, nor with the provision of any personal data to users. The Website in no way collects data that could identify users.
5.2 The Website uses Google Analytics web service provided by Google to compile statistics about the Website's visitors. The statistics are collected and stored on the Google server. The analyzed data obtained by Google Analytics includes, among other things, information about where visitors to the Website come from, how long they stay on it, which subpages they view and for how long, where they are as a geographical location by IP address used to access the device ( desktop computer, tablet, mobile phone), the words users used to find and access the Website, etc. According to the current conditions of the Google Analytics service, it does not collect data capable of individualizing the visitor to the website (such as name, personal identification number, telephone, email address, physical address, etc.).
